Terms of Service

Article 1Terms

  1. BEAUTEX Co., Ltd. (hereinafter referred to as "we") establishes these Terms in providing "DARUMARU" (hereinafter referred to as "this Site"). Customers who use this Site (hereinafter referred to as "Users") shall use this Site after agreeing to these Terms.
  2. We may amend these Terms. The amended Terms shall take effect from the time they are posted on this Site.
  3. The content of this Site and each policy are prepared in Japanese, and versions in other languages are translations provided for reference. In the event of any inconsistency or difference in interpretation between the Japanese version and versions in other languages, the definitions and interpretations in the Japanese version shall prevail. However, if this treatment is restricted by mandatory consumer protection laws and regulations in the country or region where the User resides, such laws and regulations shall prevail.

Article 2Purchase of Products, etc.

  1. Users shall apply to purchase Products by the method prescribed by us.
  2. A sales contract (including a service provision contract; the same shall apply hereinafter) shall be formed between the User and us when we accept the User's application.
  3. When a sales contract is formed with us, the User shall pay the purchase price and other charges at the time and by the payment method prescribed by us.
  4. When a sales contract is formed between the User and us, the User may not cancel the sales contract or return Products unless all of the conditions set forth below are met. Details are set forth in the Refund and Return Policy.
    1. The Products are defective, or we are in breach of our obligations.
    2. We are unable to deliver defect-free Products to the User within the period prescribed by us.
    3. If the User has received the Products, the User has requested cancellation or return within the period prescribed by us and returned the received Products.

Article 3Prohibited Acts

Users shall not engage in any of the following acts.

  1. Acts of using this Site through the unauthorized use of IDs, passwords, or credit cards.
  2. Acts that interfere with the operation of this Site or may do so.
  3. Acts that infringe upon the property rights, copyrights, design rights, trademark rights, portrait rights, privacy, or other rights of us or third parties.
  4. Purchases for the purpose of resale or other acts that circumvent the sales conditions prescribed by us.
  5. Acts that are contrary to public order and morals or may be so.
  6. Acts that violate laws and regulations or may do so.
  7. Any other acts that we deem inappropriate.

Article 4Conditions for Providing This Site

  1. We assume no responsibility for, and provide no support whatsoever regarding, the devices, software, means of communication, technology, etc. used by Users to access this Site.
  2. We may suspend or modify this Site for maintenance or other purposes without prior notice to Users.
  3. We do not guarantee that this Site will be free from interruptions, suspensions, or other disruptions.

Article 5Violations of These Terms, etc.

If a user falls under any of the following circumstances, the Company may, without any notice or demand to the user, revoke the user's eligibility and terminate any sales contract for products or other items concluded with the user.

  1. If any false or fraudulent information was provided during registration when applying.
  2. If the user violates these Terms or any contract with the Company.
  3. If it becomes known that the user is an organized crime group, a member or associate member of an organized crime group, a company affiliated with an organized crime group (collectively, “organized crime groups, etc.”), any person equivalent thereto, or a person closely associated with any of the foregoing.
  4. If the user improperly uses organized crime groups or similar entities, provides funds or benefits to such entities, or otherwise engages in conduct with such entities that is socially reprehensible.
  5. If the user violates any applicable law or regulation.
  6. Any other case in which the Company determines that the user is unsuitable as a user.

Article 6Handling of Personal Information

The Company will appropriately handle users' personal information in accordance with the Company's Privacy Policy. Users should review the Privacy Policy when using this Site.

Article 7Email Advertising

The Company may send emails advertising or promoting its products and other items to users who have requested such communications. Users may unsubscribe at any time using the unsubscribe link in the email or by contacting us.

Article 8Liability of the Company

  1. If the Company is required to compensate a user for damages in connection with products or other items purchased by the user from the Company, such compensation shall be limited to direct damages and shall not exceed the purchase price. However, this limitation shall not apply in cases of intentional misconduct or gross negligence by the Company.
  2. The Company does not guarantee the accuracy, usefulness, legality, or otherwise of information transmitted through this Site.
  3. The Company shall not be liable for any damage incurred by users as a result of using or being unable to use this Site, except where the Company has acted intentionally or negligently.
  4. The provisions of this Article do not exclude the application of the Consumer Contract Act or other mandatory laws.

Article 9Notices from the Company

Notices from the Company shall be deemed received at the time when an email would ordinarily be delivered, upon the Company sending the email to the email address registered with the Company.

Article 10Discontinuation of This Site

The Company may discontinue this Site at any time at its discretion. In such event, the Company will faithfully perform any concluded sales contracts or issue refunds.

Article 11Governing Law and Agreed Jurisdiction

  1. These Terms and all other matters relating to this Site shall be governed by the laws of Japan.
  2. If a dispute arises between the user and the Company in connection with the use of this Site, the Tokyo District Court shall have exclusive agreed jurisdiction as the court of first instance. However, this shall not apply where mandatory laws of the country or region in which the user resides provide otherwise.
